Welcome to the Fotografiska Museum (“Fotografiska”, “we”, “us”, and “our”) Web Site (the “Site”). Please read these Terms of Use (the “Terms”) carefully, including our Privacy Policy.

The following Terms describe your rights and obligations when using Fotografiska’s Site. By accessing the Site, you agree to be legally bound to all the following Terms, regardless of whether or not you are a registered or paid user. Before accessing our Site, please read through the entirety of the Terms. If you do not wish to adhere to these Terms, please do not use the Site. The right to access and use the Site is not transferable to any person or entity.

These Terms are subject to change at any time without advance notice. We will post the most updated Terms on our website with the date at which it was updated. All new Terms are effective as of the date of publishing. By continuing to use our Site after a change in the Terms, you agree to be bound by the new Terms. Please visit this page regularly to ensure that you are aware of any and all changes made to the Terms.

If you wish to know more about our data privacy practices, please visit our Privacy Policy which describes our data collection policies, privacy measures and treatment of personal information of Site users. Our Site is not meant for use or access by anyone under the age of thirteen (13).

Copyright – Use of Content

Access to and use of text, artwork, photographs, images, trademarks, data, audio files, video files and clips, software, documentation or other information contained in these files, and other content on this Site (collectively, the “Materials”) are protected by copyright, trademark and other laws and may be covered by other restrictions as well. Fotografiska and applicable third parties own or have acquired all rights to the Materials, and the materials contained within the Site.

Fotografiska expressly prohibits the copying and distribution of any protected materials on the Site, except for non-commercial, educational, and limited personal use. Unless otherwise noted, users who wish to download or print any text or image files from the Site for such uses are welcome to do so without the express permission of Fotografiska. Users must cite the author and source of this material as they would for material from any printed work; the citation should include the Site URL, but not in any way that implies endorsement of the user or the user’s use of the Materials. By downloading, printing, or otherwise using content from the Site, users agree that they will limit their use of the protected Materials to non-commercial use, will not violate the proprietary rights of Fotografiska or any other party, and will be solely responsible for any violation.

Users may not remove any copyright, trademark, or other proprietary notices, including without limitation attribution information, credits, and copyright notices that have been placed on or near the Materials by Fotografiska. Downloading, printing, copying, distributing or otherwise using Materials for commercial purposes, including commercial publication or personal gain, is expressly prohibited.

Trademarks

Fotografiska and third parties own many of the trademarks, service marks, and logos, whether registered or unregistered, (collectively, the "Trademarks") displayed on this Site. Nothing contained in this Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademarks displayed on the Site without the express written permission of Fotografiska or any third party that may own the Trademarks displayed on the Site. Any unauthorized use of the Trademarks, except as authorized in these Terms, is strictly prohibited. You agree not to use Fotografiska’s name or any of the Trademarks in any manner, including any advertising or promotional materials, that is likely to cause confusion about whether we are the source, sponsor, endorser or affiliated with any product or service. You also agree not to use Fotografiska’s name or any Trademarks to falsely suggest any relationship between you and us. In addition, you may not use our Trademarks in any manner that disparages or discredits us or infringes or violates any of our rights.

Store Product Representation

Every attempt is made to provide accurate information about Fotografiska Store products on the Site. Fotografiska does not warrant that any information, including product descriptions, promotions, and product availability, is correct, complete, current, or without typographical errors. All typographical errors, inaccuracies, and omissions are subject to correction.

Fotografiska makes every effort to present the colors of products as accurately as possible. The display of color depends on the settings of a user's particular monitor; Fotografiska cannot guarantee that the colors displayed on an individual's monitor will be correct.

Purchasing on the Site

Fotografiska has the right to refuse, limit, or cancel any orders placed on the Site. Errors in pricing or description are subject to correction and may be adjusted at any time. Errors in order processing are also subject to correction. A user must be 18 or older to make a purchase on the Site.

Links to Other Websites

The Site contains links to other websites that we think may be of interest to you. We have no control over these other sites or their content. Remember that when you link to another site, that other site is governed by its own user agreement and privacy statement, which you should be sure to read. Fotografiska has not reviewed all of the sites that link to the Site and is not responsible for the content on any of those sites linked to the Site. If you use a link to visit any other site, you do so at your own risk. A link does not imply endorsement or affiliation with the linked site by Fotografiska.

User Content

From time to time, Fotografiska may invite you to send messages, comment publicly, leave feedback and reviews, and post other content on the Site. You remain the sole owner of all intellectual property rights in what you post. You are responsible for all content you share through our Site.

Electronic Communications

When you use the Fotografiska Site and services, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this Site, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Any information containing personal data shall be handled by Fotografiska in accordance with all applicable privacy laws and regulations, including without limitation the General Data Protection Regulation (“GDPR”) and equivalent laws and regulations.

User Code of Conduct

You agree to follow the codes of conduct enumerated in these Terms on the Site. Fotografiska may decide in its sole discretion whether your content violates these rules of conduct. You are responsible for all content that you post to our Site and represent that you have permission from all copyright or trademark owners to post any copyrighted or trademarked material. You may not post content that is intentionally rude, degrading, defamatory, or otherwise offensive. You may not post identifying information of other users, access another user’s account without authorization. You may not share your account information with an unregistered or unauthorized user. You may not advertise or solicit business on our Site. You may not post any links containing viruses, trojan horses, worms, or other pieces of code designed and meant to harm others, operate on the device of another, or be used for malicious purposes. Fotografiska shall have the right, but not the obligation to inspect, monitor, review, edit, remove, refuse or delete any content for any reason whatsoever.

Security

By creating accounts and passwords on the Site, users agree to maintain the confidentiality of their login credentials and are responsible for restricting access to their personal computer and mobile devices. User agrees to use the Site for lawful purposes only and will not participate in any action that will compromise the security of the Site or damage the Site and their content. Fotografiska uses commercially reasonable efforts to best ensure the security of our Site and your information. However, no website or service is entirely secure. Termination and Modification of Site

We reserve the right to terminate the Site and these Terms at any time without notice for any reason, including, in the case of the Terms, for your violation of any of its provisions.

You agree that these Terms constitute the entire agreement and understanding between you and Fotografiska with respect to your use of the Site.

Indemnification

By using our Site, you agree to indemnify, defend, hold harmless, Fotografiska, its Affiliates, and the officers, directors, employees, licensors, service providers and agents of Fotografiska and its Affiliates, from any and all claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs resulting from or arising out of your connection to and use of our Site, your violation of these Terms, or your violation of any law or rights of a third party.

Prices

All prices on Fotografiska's website are stated in SEK incl. VAT. In the event of any price changes, the price that is currently shown on site at the time of order placement applies.

Right of withdrawal for online ticket purchases

As outlined in Article 16l of EU Directive 2011/83 and Section 11 of the "Swedish Lag (2005:59) om distansavtal och avtal utanför affärslokaler", museum and event tickets purchased online are exempt from the standard 14-day right of withdrawal for distance contracts in the EU, as they relate to leisure activities with a specific date or period of performance. Consequently, you are bound by your ticket purchase once payment has been made. If you have questions on this or a specific refund, please contact hello.stockholm@fotografiska.com.

Cancelled event/Repurchase

You are responsible for checking that the event has not been cancelled or rescheduled. If an event has been cancelled, you should contact Fotografiska, who is obliged to address any issues concerning the possible refund of tickets. In some cases, Fotografiska will refund tickets at the scheduled event. No postage or other fees paid in connection with the purchase of the ticket will be refunded following a cancelled event.

If you believe that your tickets should be repurchased, you must notify Fotografiska of your claim for a refund within two (2) months of the date of the event/day that the event would have been held. If this is not the case, you will not qualify for any refund.

Delivery

Fotografiska shop offers delivery to all member countries within the EU.

Please note that certain regions or islands within the EU may have specific delivery conditions or longer delivery times.

Delivery Time

• Standard delivery time: 5–7 business days.
• All orders are shipped from Sweden.
• Delivery time is calculated from the moment your order is ready to be shipped.
• Delivery will always take place within 30 days in accordance with EU consumer legislation.
• During public holidays, delivery may take longer, as our print house may be closed.
• Once your order has been shipped, you will receive a shipping confirmation email with a tracking link so you can follow your package.

• All costs (including shipping) are clearly displayed at checkout before you complete your purchase.
• Please note that local taxes may apply to the shipping cost depending on your delivery destination.

Returns/Right of withdrawal - online store

Returns

• You have the right to withdraw from your purchase within 14 days, starting from the day after you receive your order.
• We will refund the product price and standard shipping.
• Refunds are issued within 14 days from the day the item has been returned to us. If the process takes longer, please contact us with your proof of shipment so we can assist you.
• Return shipping costs are paid by you as the customer.

How to return an item
Email us at shop@fotografiska.com (mailto:shop@fotografiska.com) to receive a return code.

Present the code at your chosen shipping agent to print a return label.

Return the item(s) within 14 days of contacting us.

Pack the goods securely, you are responsible for the return shipping fee.

Exceptions
The right of withdrawal does not apply to goods made to order, such as posters and frames that are produced specifically after your order has been placed.

Return Shipping Costs
Return shipping costs are paid by you as the customer, unless otherwise stated. You are responsible for ensuring the item is packed securely so it is not damaged during return transport. We recommend keeping proof of shipment until your refund has been processed.

Complaints
If your item is faulty or does not match the description, you have the right to make a complaint.

• 2 years right to complain within the EU (3 years in Sweden under national law).
• Faults discovered within 12 months are presumed to have existed at the time of delivery.
• For approved complaints, Fotografiska covers the return shipping cost. You may receive a repair, replacement, or a refund.

To submit a complaint, contact shop@fotografiska.com (mailto:shop@fotografiska.com) with your order number, a description of the issue, and photos of both the packaging and the product.

Dispute Resolution
If we cannot resolve a dispute together, you may refer the matter to an alternative dispute resolution (ADR) body in your country of residence.

Terms of use

To shop in Fotografiska's online store, you must accept the terms of use. When you accept the terms, you agree to them and at the same time certify that you have read the information in our privacy policy about how we use your personal information and how we handle cookies. The purchase agreement is accepted when Fotografiska Store confirms your order. We recommend that you save this confirmation in case you need to contact Fotografiska’s customer service. You can cancel the order until you receive an order confirmation. If you cancel an order, the amount you have paid will be refunded.

Membership

We offer fully digital memberships available here on the web. By becoming a member, you accept the terms below and agree to receiving information about current offers and activities.

When logged in as a member, you can book entrance tickets free of charge, get access to membership prices on Fotografiska Live events, as well as benefits in the bistro, restaurant and store. As logged in to My account, you can see all your membership benefits, your purchase and payment history and administer the settings for your membership.

Right of withdrawal

You have the right according to Swedish law to cancel the purchase of membership on Fotografiska's website within a period of 14 days after the time of purchase. Contact our member service on members.sto@fotografiska.com if you wish to withdraw your purchase and we will help you further.

Validity and termination

Annual membership agreement in Fotografiska Familjen is valid for 12 months from the time of purchase. Monthly memberships have a minimum of 6 months subscription. At the end of the agreement period, the membership is automatically renewed with a new payment setup. If you do not wish to renew your membership, cancel by clicking “Stop auto-renew” when logged in to your account. Do this before current membership period ends. The 14-day right of withdrawal also applies to renewed membership from the time a new fee has been deducted. Contact our membership service on members.sto@fotografiska.com if you wish to withdraw the purchase of renewed membership and we will help you further.

During the subscription period, a price guarantee applies to the member, which guarantees that the price remains the same during the subscription period. When the agreement / subscription period has expired and if a price change has taken place, the price changes to the new specified the month after the subscription period has expired. If signing up using a gift card as a means of payment, membership is only valid for one year, without an ongoing subscription. At the end of the membership period, an offer will be sent to extend the membership with a subscription.

Changes to membership terms

Fotografiska reserves the right to make changes to membership terms, benefits and prices. Before a change in terms or price takes effect, you as a member are informed in advance through Fotografiska's channels; website and email. Active memberships remain protected against price increases until the subscription period has expired. If you do not wish to renew your membership after any change in terms, please contact our membership service.

Refunds

In all cases where a refund is issued by Fotografika the refund will be issued to the payment method that was originally used for payment. Refunds will not be issued to other payment methods, and are never transferable to cash.
